Vehicle Listing Terms
1. Advertiser Listing Agreement
This Agreement is between you (the Seller) and Earlville Media LLC (operated by William Porta), which publishes Earlville.com (the Site). By purchasing a vehicle listing, you agree to these terms in addition to the Site's Terms of Service and Acceptable Use Policy.
1.1 What you are buying
The vehicle listing is an optional, one-time purchase of a premium standalone listing page for a single vehicle, published on the Site with featured placement in the Autos section for a fixed term of 60 days. The price is shown at checkout (currently $99.00 USD). It is a digital advertising service. It does not include the sale of any vehicle, brokerage, escrow, inspection, or any guarantee of views, inquiries, or a sale.
1.2 Earlville Media LLC is a venue, not a party
Earlville Media LLC provides the advertising platform only. It is not a party to any sale, does not take title to or possession of any vehicle, does not hold or escrow funds, does not set prices, and does not verify, inspect, or warrant any vehicle, title, or listing. Any transaction is strictly a private, party-to-party, as-is sale between the Seller and the buyer. You are solely responsible for the accuracy, legality, and completeness of your listing.
1.3 Private-party sales only; no curbstoning
You represent that you are the owner of the vehicle or are legally authorized to sell it, and that this is a private-party sale. This service is not for licensed or unlicensed motor-vehicle dealers. Advertising vehicles you do not own, or listing dealer inventory as a private party (curbstoning), is prohibited and may violate New York law. Earlville Media LLC may remove any listing it believes involves dealer activity or curbstoning.
1.4 Odometer and condition
You must state the vehicle's actual mileage to the best of your knowledge. Federal and New York law require an accurate odometer disclosure on the transfer of most vehicles less than twenty years old (generally model year 2011 and newer at present). You must disclose known material defects and must not roll back or misrepresent the odometer, wash or alter the title, or misrepresent the vehicle's history, condition, or branding (for example salvage, rebuilt, or flood).
1.5 Your content and our license
You keep ownership of the text and photos you submit. You grant Earlville Media LLC a non-exclusive, royalty-free license to host, display, resize, and promote that content on the Site and in related promotion of the Site for as long as your listing (or its cached or archived copies) remains available. You represent that you have the right to submit the content and that it does not infringe anyone's rights.
1.6 Moderation and removal
Listings are reviewed and may be automatically screened. Earlville Media LLC may edit, decline, hold, or remove any listing at its discretion, including for inaccuracy, prohibited content, suspected fraud or curbstoning, or violation of law or the Acceptable Use Policy, with or without notice. Removal for a violation does not entitle you to a refund (see Section 2).
1.7 Prohibited
You may not list stolen vehicles; misrepresent ownership, mileage, title status, or condition; advertise as a private party while acting as a dealer; include unlawful, obscene, or fraudulent content; or use the Site to harass or deceive. Prohibited-item rules in the Acceptable Use Policy also apply.
1.8 Disclaimers and limitation of liability
The service is provided as is and as available, without warranties of any kind. To the fullest extent permitted by law, Earlville Media LLC is not liable for any dispute, loss, injury, or damages arising from any vehicle, listing, or transaction, and its total liability relating to a listing will not exceed the amount you paid for that listing. You agree to indemnify Earlville Media LLC for claims arising from your listing or sale.
1.9 Governing law
This Agreement is governed by the laws of the State of New York, and the parties submit to the courts located in Madison County, New York. If any provision is unenforceable, the rest remains in effect.
2. Refund & Cancellation Policy
2.1 One-time charge, no auto-renewal
The vehicle listing is a single, one-time charge of $99.00 USD. It does not automatically renew, and we do not store your card to bill you again. When the 60-day term ends, the listing simply expires. There is nothing to cancel.
2.2 Digital service, delivered immediately
This is a digital service delivered electronically. Once your payment succeeds and your listing is published, the service (a live, featured listing page) has been delivered. Featured placement increases visibility but does not guarantee any number of views, inquiries, or a sale.
2.3 Refunds
Because the listing is delivered immediately and its value is provided as soon as it goes live, listing fees are generally non-refundable once the listing has been published. We will, however, gladly refund a duplicate or erroneous charge, or a failure to deliver (your payment succeeded but the listing never went live due to a technical problem on our end). If we remove your listing because it violates this Agreement, the Acceptable Use Policy, or the law, no refund is due. If we decline a listing during review before it is published and do not deliver the service, we will refund the fee.
2.4 No prorated refund for early removal
If you sell the vehicle, delete, or hide your listing before the 60-day term ends, that does not entitle you to a prorated or partial refund. The listing is sold as a fixed 60-day term, not by the day.
2.5 How to request a refund or get help
Please contact us first. Email support@earlville.com with your transaction date, amount, and the vehicle it relates to. We aim to respond within 2 business days. Approved refunds are issued to your original payment method through our payment processor, Elavon.
2.6 Before you file a chargeback
Card payments are processed securely by Elavon; we never see or store your full card number. If a charge looks wrong, please email support@earlville.com before disputing it with your bank. We can almost always resolve duplicate or mistaken charges faster than a chargeback.
3. Seller disclosures (plain language)
- Private sale, as-is. You are selling to another person directly. There is no warranty unless you put one in writing.
- You are not a dealer. If you are in the business of selling cars, this service is not for you.
- Odometer. State the true mileage. For most vehicles model year 2011 or newer, a written odometer disclosure is required at the time of sale.
- Title. Disclose the true title status (clean, salvage, rebuilt, or a lien to be paid off at sale). Never wash or alter a title.
- Earlville Media LLC is just the billboard. We host your ad. We are not involved in your sale and cannot help with disputes between buyer and seller.
