Housing Listing Terms
1. Listing Agreement
This Agreement is between you (the Lister) and Earlville Media LLC, which publishes Earlville.com (the Site). By posting a housing listing you agree to these terms in addition to the Site's Terms of Service and Acceptable Use Policy.
1.1 What the service is
A housing listing is a local classified advertisement for one specific property — an apartment or home offered for rent, or a property offered for sale — published on the Site's Housing page for a fixed term of 30 days. It is a digital advertising service only. It does not include brokerage, agency, property management, tenant screening, escrow, inspection, or any guarantee of views, inquiries, a tenant, or a sale.
1.2 Earlville Media LLC is a venue, not a party
Earlville Media LLC provides the advertising platform only. It is not a party to any lease or sale, is not a real-estate broker or agent, does not hold funds, does not set prices or rents, and does not verify, inspect, or warrant any property or listing. Any lease or sale is strictly between you and the other party. You are solely responsible for the accuracy, legality, and completeness of your listing.
1.3 Who may list
You represent that you are the owner of the property or are legally authorized by the owner to advertise it. Listing a property you have no right to offer is prohibited. Licensed real-estate professionals may list a property they are engaged to sell or rent, and are solely responsible for complying with the advertising rules of their license.
1.4 Your content and our license
You keep ownership of the text and photos you submit. You grant Earlville Media LLC a non-exclusive, royalty-free license to host, display, resize, and promote that content on the Site and in related promotion of the Site for as long as your listing (or its cached or archived copies) remains available. You represent that you have the right to submit the content and that it does not infringe anyone's rights.
1.5 Moderation and removal
Listings are reviewed and may be automatically screened. Earlville Media LLC may edit, decline, hold, or remove any listing at its discretion, including for inaccuracy, discriminatory content (Section 3), prohibited content, suspected fraud, or violation of law or the Acceptable Use Policy, with or without notice. Removal for a violation does not entitle you to a refund (see Section 2).
1.6 Prohibited
You may not: list a property you have no right to offer; misrepresent the property, its condition, price, or availability; post discriminatory preferences or limitations (Section 3); collect application fees, deposits, or rent through this Site; run bait-and-switch ads; or include unlawful, obscene, or fraudulent content.
1.7 Disclaimers and limitation of liability
The service is provided as is and as available, without warranties of any kind. To the fullest extent permitted by law, Earlville Media LLC is not liable for any dispute, loss, injury, or damages arising from any property, listing, lease, or sale, and its total liability relating to a listing will not exceed the amount you paid for that listing (zero, for a free listing). You agree to indemnify Earlville Media LLC for claims arising from your listing or transaction.
1.8 Governing law
This Agreement is governed by the laws of the State of New York, and the parties submit to the courts located in Madison County, New York. If any provision is unenforceable, the rest remains in effect.
2. Pricing, Term, Refunds & Cancellation
2.1 First listing free
Each household (identified by contact email) may have one active listing at a time free of charge. A free listing runs for 30 days and then expires; you may relist it free whenever you have no other active listing.
2.2 Additional listings — $9.99 per month
Each additional active listing costs $9.99 USD per 30-day term, charged when you post it. The charge does not automatically renew — we do not store your card. When the 30-day term ends, the listing expires; to keep it running, simply pay for another 30-day term. There is nothing to cancel.
2.3 Digital service, delivered immediately
A paid listing is a digital service delivered electronically. Once your payment succeeds and the listing is published, the service has been delivered. Publication does not guarantee any number of views, inquiries, a tenant, or a sale.
2.4 Refunds
Paid listing fees are generally non-refundable once the listing has been published. We will gladly refund a duplicate or erroneous charge, or a failure to deliver (your payment succeeded but the listing never went live due to a technical problem on our end). If we decline a listing during review and never publish it, we will refund the fee. If we remove a listing because it violates this Agreement, fair-housing law, the Acceptable Use Policy, or other law, no refund is due.
2.5 No prorated refunds
If your place rents or sells before the 30-day term ends — congratulations! — that does not entitle you to a prorated or partial refund. The listing is sold as a fixed 30-day term.
2.6 How to get help
Email support@earlville.com with your transaction date, amount, and the listing it relates to. We aim to respond within 2 business days. Approved refunds are issued to your original payment method through our payment processor, Elavon. If a charge looks wrong, please email us before disputing it with your bank — we can almost always fix it faster than a chargeback.
3. Fair housing (required, and important)
Housing advertising is regulated. Your listing must comply with the federal Fair Housing Act and the New York State Human Rights Law.
- Describe the property, not the people. "Sunny 2-bedroom, off-street parking" is fine. "Perfect for a single professional, no kids" is not.
- Your listing may not state a preference, limitation, or discrimination based on race, color, national origin, religion, sex, familial status (including children), disability, and — under New York law — age, marital status, sexual orientation, gender identity or expression, military status, or lawful source of income (including benefits and housing vouchers).
- Reasonable, lawful statements about the property (e.g. "no smoking inside," "2nd-floor walk-up") are fine.
- We will edit, hold, or remove listings that violate these rules, without refund, and repeat violations will end your ability to list.
